1. Acceptance of Terms

By accessing or using the services provided by Aftershock Restoration ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

Aftershock Restoration provides emergency restoration services including but not limited to:

  • Water damage restoration and emergency extraction
  • Fire and smoke damage cleanup and restoration
  • Mold remediation and prevention
  • Biohazard cleanup services
  • Asbestos abatement
  • Structural drying and restoration
  • Storm damage restoration

3. Service Availability

We provide 24/7 emergency response services. While we strive to respond promptly to all emergency calls, response times may vary based on location, weather conditions, and current demand. We make no guarantee of specific response times unless explicitly agreed upon in writing.

4. Pricing and Payment

Service pricing is determined based on the scope of work, materials required, and time involved. We provide estimates prior to beginning non-emergency work. Emergency services may be initiated before a full estimate is available to prevent further damage.

Payment terms will be outlined in your service agreement. We work directly with insurance companies and can assist with the claims process. You are responsible for any costs not covered by insurance.

5. Insurance Claims

We work with all major insurance providers and can assist with documentation and the claims process. However, the insurance policy is an agreement between you and your insurance provider. We are not responsible for coverage decisions made by your insurance company.

6. Property Access and Safety

By requesting our services, you grant us access to your property for the purposes of inspection, assessment, and restoration work. You are responsible for securing any valuables and personal items prior to our arrival. We take reasonable precautions to protect your property but are not liable for damage to items not directly related to our scope of work.

7. Limitation of Liability

Our liability is limited to the direct costs of our services. We are not liable for indirect, incidental, or consequential damages arising from the use of our services or delays in service delivery. Our total liability shall not exceed the amount paid for the specific services in question.

8. Cancellation Policy

You may cancel services at any time; however, you will be responsible for work already completed and materials already ordered. Emergency response fees and assessment charges are non-refundable once technicians have been dispatched.

9. Warranty

We stand behind our work and provide warranties on specific services as outlined in your service agreement. Warranties do not cover damage resulting from subsequent events, natural disasters, or failure to maintain the property appropriately.

10. Indemnification

You agree to indemnify and hold Aftershock Restoration harmless from any claims, damages, or expenses arising from your use of our services, except where caused by our negligence or willful misconduct.

11. Governing Law

These Terms of Service are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Alberta.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
